1. Acceptance of Terms
By downloading and using The BS Bingo Game, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the application.
2. License Grant
Recess Kitchen Pty Ltd grants you a limited, non-exclusive, non-transferable license to download and use The BS Bingo Game for personal, non-commercial use on your mobile device. This license is revocable at any time.
3. Use Restrictions
You agree not to:
- Use the app in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to the app or its systems
- Engage in any behavior that is abusive, threatening, or harassing toward other users
- Upload or share content that is illegal, offensive, or violates others' rights
- Attempt to circumvent any access restrictions or security features
4. Subscriptions and In-App Purchases
The BS Bingo Game offers optional subscription plans (Premium) to unlock additional features, including the ability to create custom word lists. Subscriptions are billed through your device's app store (Apple App Store or Google Play) and are subject to their billing policies.
By purchasing a subscription, you authorize Recess Kitchen and the app store to charge your payment method on a recurring basis. You may cancel your subscription at any time through the app's account settings or the app store.
Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the period, in line with the app store's standard billing policies. Cancelling stops future renewals but does not entitle you to a refund of the current period. Premium features remain available until the end of the paid period, after which your account reverts to the free tier.
All payments are processed by Apple or Google, and refunds are handled exclusively through their respective platforms under their refund policies. Recess Kitchen does not issue refunds directly. Where the law in your jurisdiction provides non-excludable refund or consumer rights (for example, under the Australian Consumer Law), nothing in these Terms limits those rights.
5. Account Deletion
You may delete your account at any time through the app's account settings. Upon deletion, your data is removed from our active systems immediately and is no longer accessible. Residual copies may persist in encrypted backups for up to 30 days before being overwritten in the normal course of our backup rotation, after which all copies are permanently deleted. This action cannot be undone. For further detail, see our Privacy Policy.
Recess Kitchen may also suspend or terminate your account, with or without notice, if we reasonably believe you have breached these Terms, if required by law, or if continued provision of the service to you is no longer commercially or technically viable. Where possible, we will give reasonable notice before terminating your account in the absence of a breach. Any outstanding subscription period will be handled in accordance with the app store's billing policies.
6. Intellectual Property
All content, design, and functionality of The BS Bingo Game, including word lists, code, and graphics, are owned by or licensed to Recess Kitchen Pty Ltd. You may not reproduce, modify, or distribute any part of the app without permission.
7. User-Generated Content
Any custom word lists, game sessions, and messages you create are your responsibility. By using the app, you grant Recess Kitchen a license to store, process, and display this content as necessary to provide the service.
Recess Kitchen does not proactively monitor user-generated content, but reserves the right to review, remove, or restrict any content (including chat messages and custom word lists) that it reasonably believes violates these Terms or is otherwise harmful, offensive, or unlawful. Recess Kitchen is not responsible for user-generated content and does not endorse any views or material posted by users.
The BS Bingo Game is primarily intended to be played among people who know each other by private invitation. Users are responsible for who they invite to their games and for the conduct of those they invite. If you believe another user has seriously violated these Terms or applicable law, you may contact us at support@playbsbingo.com. We may, at our discretion, remove content, suspend or terminate accounts for violations, and may take these actions without prior notice where we consider it necessary to protect users or comply with law.
8. Limitation of Liability
The BS Bingo Game is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Recess Kitchen Pty Ltd disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Recess Kitchen Pty Ltd is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or service interruptions, arising from or related to your use of or inability to use the app. Where liability cannot be excluded by law, our total aggregate liability to you is limited to the greater of (a) the amount you have paid to Recess Kitchen in the twelve months preceding the event giving rise to the claim, or (b) AU$100.
Nothing in these Terms excludes, restricts, or modifies any consumer rights or guarantees under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.
9. Third-Party Services
The BS Bingo Game uses third-party services including AdMob for advertising. These services may collect data according to their own privacy policies.
10. Modification of Terms
Recess Kitchen reserves the right to modify these terms at any time. Changes will be posted in the app, and your continued use constitutes acceptance of the updated terms.
11. International Compliance
The BS Bingo Game is available globally. Users in the European Union and California are subject to additional privacy and data protection regulations (GDPR and CCPA respectively). Please refer to our Privacy Policy for details on how these regulations apply to your use of the app.
12. Dispute Resolution
These terms are governed by the laws of Australia. Any disputes shall be resolved in the courts of New South Wales.
